§ 1Not medical advice
Nothing on Whalespan is medical advice. We audit public claims against the academic literature. We do not diagnose, treat, or recommend interventions, and we are not a substitute for a clinician. Talk to a doctor before changing anything you do with your body. You are solely responsible for decisions you make using the service.
§ 2Accounts and subscriptions
Some features require an account and a paid subscription. You are responsible for keeping your credentials secure and for activity under your account. Subscriptions renew automatically until cancelled; you can cancel anytime and retain access through the end of the current billing period. Fees are billed through our payment processor and are non-refundable except where required by law.
§ 3Acceptable use
Do not scrape, resell, or bulk-export the audit corpus; do not attempt to defeat access controls; do not use the service to harass speakers or to misrepresent our verdicts. We grant you a personal, non-transferable licence to read and reference our content with attribution. Automated access requires written permission.
§ 4Fair use of source material
Whalespan quotes transcript excerpts from publicly available content for editorial commentary and critical analysis. We believe this falls within the fair-use doctrine of US copyright law (17 U.S.C. § 107): the use is transformative (an audit), the source is public, and the excerpts are limited to what the analysis requires. Rights-holders with a concern may contact legal@whalespan.com.
§ 5Coverage limitations
We do not currently audit content behind paywalls we cannot legally access, private communications, or content in languages other than English. Coverage is incomplete by design and expands over time. Absence of a verdict is not an endorsement.
§ 6Disclaimers and limitation of liability
The service is provided “as is,” without warranties of any kind. To the maximum extent permitted by law, Whalespan is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the fees you paid in the twelve months before the claim. Some jurisdictions do not allow these limits, so they may not apply to you.
§ 7Indemnification and termination
You agree to indemnify Whalespan against claims arising from your misuse of the service or violation of these terms. We may suspend or terminate access for breach; you may stop using the service at any time. Sections that by their nature should survive termination (disclaimers, liability limits, governing law) do.
§ 8Governing law and jurisdiction
Whalespan is operated from the United States. These terms are governed by the laws of the State of Delaware, and disputes are subject to the courts located there. See also our Editorial Standards and Privacy Policy.
